<div><em><strong>Kick IT</strong> asked: </em><br/><br/><br/>I&#8217;m in a sticky situation.  My ex-husband and I (when were married) filed for Chapter 13.  SInce the divorce, I pay half the bankruptcy payment and he the other half.  At the time we filed, we included our car payments in the bankruptcy, so until our last bankruptcy payment(which will be in 2 years, the lien holder will still have the title to my car.  Since I&#8217;m still paying in bankruptcy and the lien holder has my title, I have to pay full coverage insurance(state law-GA).  Well my car is finally inoperable and I am paying cash for another.  Well it is operable but I refuse to put MORE money into a piece of junk to get it fixed. How do I get out from under paying insurance and registration on the old one without a title?  Can I turn the car back over to the lien holder with no further obligation?  What are my options?<br/><br/></div>

I would need to make 100000/year to do it, and I am lucky to have made 49000/year.  I only left the company because their are alot of shady things going on and I have been in this situation before and I did not want to be in it again, so I left the company.  I am trying to search for another job, but I am out of money.<br />
I have 13000 in my bank account, I need this money to make my rent and stuff.<br />
Now I know they changed the bankruptcy laws in 2005 thats makes it harder to file chapter 7, and I made 49000 a year which is over the median for 1 person.  But since I do not have a job now, what do I do?  I do not have any income coming in, do you think that without a month of income coming in, I would be under the 49000?  If I do Chapter 13, would I still have to pay the 110000 over a period of time?  Any suggestions&#8230; should I stop making my payments?<br/><br/></div>

<p>Comes now M. Elaina Massey, chapter 13 trustee in the above referenced case, and objects to confirmation of the proposed chapter 13 plan for the reasons stated herein:</p>
<p>DEBTOR DOESN&#8217;T PROPOSE TO PAY ALL DISPOSABLE INCOME INTO THE PLAN FOR THE BENEFIT OF THE UNSECURED CREDITORS.</p>
<p>Wherefore, the Trustee moves the court to inquire into the above objections, deny confirmation of the proposed plan, or dismiss the chapter 13 case.</p>
<p>Does that mean I&#8217;m already denied the plan? Help! I&#8217;m still barely paying my regular bills now and I can&#8217;t afford to be digging that hole again!!<br/><br/></div>

<p>I understand some of the fees are included in the Chapter 13 plan and paid over time.</p>
<p>I just want to know approximately how much I have to come up with in the beginning, out of my pocket, to file.</p>

We receive long term disablity as well. that our attorney showed as income. When filing our papers our attorney did as the new law states, which in turn showed that we owed zero amount to our creditors since the social security was not to be included. When we went before the Trustee for the 341 meeting, the Trustee  did not feel that it was right for us to owe nothing and challenged our attorney to prove to him why the social security that we receive should not be included  as income.  Does a Trustee have the capacity to request this?   He wants us to pay something, but why should the law change?   Has there been a similar case since the law changed in 2005?<br/><br/></div>
