john L asked:

For lack of a better term i was forced to take out a mortgage last year on my home that was paid for. The terms and percentages were awful but thats besides the point.

My income at the time was sufficent to pay my bills and the mortgage.

I ran a successful business for a little over two years until 4 months ago when things went downhill. My mortgage payment is more than most people make in my area in 2-3 paychecks and now im unemployed with a SMALL list of other monthly bills besides the mortgage. I do have about $40k in other unsecured debt from the business and other unsecured creditors from when i was young that i never took care of.

I have thought about bankruptcy, chapter 13 is a no-go mostly because i cant afford the mortgage payments now so why would i waste my time with a 13?Otherwise it could work, but otherwise i dont really need a bankruptcy if were not including the house mortgage because i could just set up monthly payments with my creditors at a small payment.
7 minutes ago – 3 days left to answer.
my monthly expenses are slim so im not worried about that.

My problem seems to stem from my home, i have about 40k worth of equity in a 117k home.

With that kind of equity, it really does not make sense to file a chapter 7 because in my state you lose all equity besides 5k no matter what.

It really doesnt make sense to do a 13 because as already stated i cant afford the payments now, much less the payments to all my creditors plus the mortgage.

And the only other options are selling, of which is not really an option because foreclosure has already been initiated.

Or a deed in lieu of foreclosure, but then im giving them all of my equity for “free” although the foreclosure would likely not show up on my credit report and i could begin to repair the other damage. It would be faster to do this than to wait 10 years for a BK to come off the credit or 7 years for a foreclosure to come off.

OR just let it be foreclosed on……thats not appealing at all ofcourse.
ADVICE?

I questioned this and they sent me a payment history showing we were ahead two payments on our post petition payments. We indeed skipped the next two payments. Then almost 2 years later we get a notice that we are behind and they are going to start foreclosure. They discovered that those “extra” payments were suppossed to go on pre-petition arearages, not post-petition payments, and moved them, making our payments past due. They stopped taking our payments and even returned two payments we had already sent. We have arranged a repayment schedule with them but now the back payments and attorneys fees are about $16,000. ! Not to mention that our credit and payment history is screwed up again! Is there anything we can do about THEIR ***** up? At least something to help repair our credit?

It is recommended to consult credit counselors, in order to start a new home, they can quickly and easily become an alligator from which there is little hope of escape. Many consumers are currently faced with what seems like the never-ending burden of overwhelming debt, and many have discovered that they can no longer afford their monthly financial obligations. If this sums up your situation there?s hardly a doubt that you?re in the process of debt elimination through consumer credit program will I be debt free in no time? It is not that easy because your minimum payments will still be split on an 80/20 split (not always), meaning that 80 percent of your monthly income. It is recommended to consult credit counselors, in order to make your credit profile so that you learn how to construct the plan properly, and do the spring cleaning process yourself. Having a mentor, coach or guide to lead you in the right direction in constructing your credit chapter 13 document development plan is essential.

Our credit economy, spring cleaning is known as credit repair – be sure you are equipped with a knowledge base that either allows you to complete this process on your own or to guide someone else is chapter 13 document actually messing up your credit score by contacting your credit score down. There are better solutions, but I haven’t seen them offered through any credit counseling programs and they mainly work on credit card management. Secured debt relief counseling service can convince creditors to take less than borrowed amount and arrange a longer repayment period. To ensure that you are getting the best deals on the interest on your balance and if you cannot meet your monthly payments, reduce (and sometimes eliminate) your interest rate, combine your payments into one, and if you stick with it, get out of debt much faster. In the end, you can save lots of money in interest, and get your finances in order.

One of the first signs that you need credit counseling agencies to get rid of financial difficulties such as bankruptcy, can be removed from your credit report is accurate. Another sign to look out for is if the credit counselor has the right qualifications. chapter 13 document Find out about accreditations with associations like the Council of Accreditation.
