spadestransport2002 asked:
we are about to file chapter 13 bankruptcy and we originally didnt want to give up anything but since our consult with the lawyer we changed our mind about our car now i cant reach my lawyer because hes in court but i am curious about how it works when we surrender the car will they sell the car and add the difference into our bankruptcy. the car is a pile of junk and just ran out of warranty so in 5 years it really is going to be junk so we need to get rid of it. is this how it works or am i missing a lot of something. im fully aware of the ramifications of chapter 13 and we do not qualify for chapter 7 and this is the onl way to keep our house so help would appreciated.
we havent started the process all we have done is consult the lawyer we havent filed yet.
also my mother-in-law and father-in-law have a 2007 chrysler 300 that they said we cantake over paying for and it will be paid for in 3 years not 5 and the car we are getting rid of is a 2006 chrysler pasifica so we got that covered.

If you have left a message with your lawyer, then just wait for him to get back to you. You should still have time if the original paper work has not been filed. If not, you may have to get your case amended.
That really sux… I’m sorry! =(
will the 10 year old junker you will have to buy because of your upcoming bankruptcy be any better of a car
cars don;t become junk in 5 yrs – how can it be junk after only 2-3 yrs?
– I voluntarily repo’d a car once – It was a yr, i had just gotten separated, then lost my job – gave the car back – after they sold it for 1/3 of the loan balance, they added on repo fees and other stuff and I still wound up owing as much as when I had the car – that and other debts forced me into bankruptcy – so you may still have to pay a good chunk of that money to the car loan company in chap 13 and it will take about 7 yrs after your bankrup is done before you get a decent rate on a car loan again
