    You will not get back what you paid, however since your credit is already ruined a Chapter 7 may be in your best interest. Do make sure you won’t lose any assets though, if you are concerned about this. Without your Chapter 13 payments it will really make your other monthly payments a lot easier to make!

    If you have made payments and have they have been distributed to creditors, you will not receive the money back. If there is money left over, it may be turned over to your Chapter 7 trustee unless you can claim it as exempt. What you really need to to is contact a qualified bankruptcy attorney, preferably a member of the National Association of Consumer Bankruptcy Attorneys.
