I have already spoke with a Louisiana Bankruptcy attorney and was told I qualify for chapter 13. The only problem is that I found a new job in Florida that starts in January 09 (would need to move in less than two months). I was told by the attorney that it would take about three months to file the chapter 13.

My questions are: Can I just wait until I move and file in Florida? Or, could I file here in Louisiana, but move before the case is complete; furnishing documents etc by fax or fed-ex.
I own a home (here in LA), which I plan on letting the bank take back as I am not up-side-down on or ahead as far as equity goes. Everything else (one vehicle, unsecured debt and a CC) will be rolled into the ch. 13.
Any advice would be greatly appreciated!

You can file in Florida and you will still be under the Louisiana laws as you have to live in Florida fo so long in order to qualify for that. So even though you live there it would be like you are still filing in Louisiana. I am going through it in NC. I moved from Florida to NC and have to go by the the Florida guidelines.
This is exactly the sort of technical legal question that you need to address with attorney….preferably one in Florida…Never rely on this forum for free legal advise…any legal advise may be wrong and may cost you dearly.
