In December of 2007 my husband filed Chapter 13 Bankruptcy. I did not file. We normally file our taxes married jointly and with our 4 children end up with a return of about $9900.00. The attorney said he can only keep $600 of his tax refund … where does that leave me since we are filing together and I did not file with him? Any help is appreciated!
I have about $8500 income for 2007 and we live in Missouri.

I believe the attorney is saying that the tax refund is an asset of the bankruptcy court and that they will take all but $600 of it to pay creditors.
Did you have any income in 2007? What state are you in?
