My husband and I are in the process of filing for bankruptcy…we have signed the papers and everything and our lawyer advised us not to make any more payments that the arrears would be paid up in our payments to the trustee, well my car payment was due and payable the day we went…not yet behind mind you, and we did not pay it as instructed. Now the financial center has called and said that since I don’t have a case number yet..( I will have one in like 2 days) that they have to put an order for repossession of my car…I called my lawyers office and asked if they could do this….they said that yes they could, but that they would have to give it back. I’m still worried about it though…and to be honest the worth of the car is way less than the blue book pricing which is what they will get paid with the bankruptcy, they stand to make more money off of me by letting me wait the day or two to get my case number..it’s crazy…anyhoo…l was wondering if anyone had any experience with this and whether or not they actually ended up losing their car? Please no ugly answers..I’m filing chapter 13 even though I could file for 7 because I do want to try and pay back at least some of my debt, but I kind of need to feed my kids and that’s getting extremely hard my husband has lost a day a week at his job for three months now and my hours have been knocked from 40 to 24….were just too far gone to recover on our own…the car was actually one of the only things that wasn’t behind..anyways any help or advice (nice advice) that you could give would be great!!

    They can’t repo that car and they know it, if they do the court will order them to give it back if you want it back, they have to hold for so long before they can sell it, everything will be in place before sell time comes up, call your lawyer and ask him, I done the chapter 13 and started paying the trustee in a week from filing my papers, a soon as your lawyer files those papers it s a automatic stay, no one can do nothing, they want that car because they don’t want the reduced payment and reduced interest rates, it will take them longer to get their money and as long as your in the plan they can’t touch that car an they know it, it will be on the courts terms and not thiers, they can’t stand that neither, LOL :O) but hurry and get those papers filed with a lawyer, I didn’t get the point of how your car creditor knew that you were filing bankruptcy but never tell any of your creditors that your going to until you have, but I know if you have your lawyer he can et that car back, good luck, it will all work out if you hurry, I agree wit this answer above mine, keep the car hid, it will take them seconds to hook to that car and it will be gone, hide it !!
