When filing our papers our attorney did as the new law states, which in turn showed that we owed zero amount to our creditors since the social security was not to be included. When we went before the Trustee for the 341 meeting, the Trustee did not feel that it was right for us to owe nothing and challenged our attorney to prove to him why the social security that we receive should not be included as income. Does a Trustee have the capacity to request this? He wants us to pay something, but why should the law change? Has there been a similar case since the law changed in 2005?

I recently had filed bankruptcy chapter 13 and had a 341 meeting few days ago…but I have a mortgage on my name, which is also on two other ppl, 3 owners. my attorney told me that mortgage will not be affected. The house is on the market, and we just got an offer few days ago, when we tried to do all the papers, countrywide refused to talk to other 2 owners, said that house is under bankruptcy!!! but it wasnt included…my case worker said that bank just need a some kind release form, and there will be a trial, but it will take 30-45 days and we might loose the offer. dont know what to do…

I attended my 341 meeting this morning and trustee strongly recommended that I speak with an attorney because, at this point, she would file a motion to have my bankruptcy dismissed. The trustee said that the process is extremely difficult and she has never seen anyone successfully complete a ch 13 on their own. I’d like someone with knowledge or experience in ch 13 bankruptcy to give me details on what makes ch 13 so difficult. I spent hours researching the laws and studying so that I could do this. It doesn’t seem that difficult to me, but the trustee says my chances are almost zero. Please explain this to me. Thanks.
