we are about to file chapter 13 bankruptcy and we originally didnt want to give up anything but since our consult with the lawyer we changed our mind about our car now i cant reach my lawyer because hes in court but i am curious about how it works when we surrender the car will they sell the car and add the difference into our bankruptcy. the car is a pile of junk and just ran out of warranty so in 5 years it really is going to be junk so we need to get rid of it. is this how it works or am i missing a lot of something. im fully aware of the ramifications of chapter 13 and we do not qualify for chapter 7 and this is the onl way to keep our house so help would appreciated.
we havent started the process all we have done is consult the lawyer we havent filed yet.
also my mother-in-law and father-in-law have a 2007 chrysler 300 that they said we cantake over paying for and it will be paid for in 3 years not 5 and the car we are getting rid of is a 2006 chrysler pasifica so we got that covered.

chapter 13 bankruptcy attorney
river85715 asked:

I am in the process of filing chapter 13. My trustee recommends that I seek the advice of a lawyer. However, a lawyer is not in the budget right now. The trustee says that only a few cases will be successful without an attorney. Are there any trustees or attorneys out there that could give me a few tips for making my own case successful? Any sure fire ways to be sure I am successful on my own with this case? Any advice would be greatly appreciated. Thanks.
