<div><em><strong>Michael F</strong> asked: </em><br/><br/><br/>My Ex and I filed bankruptcy in 2002. I paid the first payment on Dec. 3, 2003. There were 2 vehicles involved. On Oct. 4, 2004, we both signed an agreement saying that she would pay $125 every other week. The bankruptcy was supposed to be paid at $440 per month. I had the truck which I acquired before we got together. She got the car. The $440 per month was paid to where 75% of the amount was going to her car and the other 25% was going to my truck.</p>
<p>In December 2005, I realized that I had a 4 year old truck that I was paying $440 per month at and she was paying nothing and getting a free car per our &#8220;divorce&#8221;. The attorney would not include the agreement we made outside in the Divorce because it was a bankruptcy.</p>
<p>So- I let them Repossess my truck and they came and took her car. (She wasn&#8217;t too happy).</p>
<p>At $250/ month from October 2004 through December 2005- She &#8220;owes me&#8221; $3,750.</p>
<p>I want to take her to small claims for this amount. Is this claim legit in your opinion? I don&#8217;t want to waste my time. What about interest?</p>
<p>(Honestly, I would normally let this go, but in 2008, I have spent $6,000 in attorney fees, forgiven $3,000 in medical costs for my Son for her to simply sign over her rights. I can&#8217;t go buy a truck so that I can go to work because my credit is shot to hell with a bankruptcy, and 2 repossed vehicles on it. This money would help me put a nice down payment on another vehicle.)</p>
<p>Oh also, in October 2006 she signed a paper admitting that she did owe atleast $2,100 for bankruptcy. (This was when she brought the car over to get repoed) I also have a copy of the one and only payment/ check that she paid me in 2005 for $50 stating in the memo that it was for the bankruptcy payment.<br />
The claim for the bankruptcy was for a total of $25,407. I paid $11,010.33 total. She paid $50.</p>

<p>It is not notarized though. But she also acknowledged that she owed by paying $50 one time and signing in 2006 stating that she did owe atleast $2,600 something, but it was not notarized either.<br/><br/></div>

<p>And just for everyone&#8217;s edification&#8230; it was not because we had out of control debt.  It was because we had a child that was born with extensive medical needs far and beyond our insurance and the fact that I needed to stop working for 3 years.  It was all medical debt.<br />
